TERMS AND CONDITIONS OF SALE
Last Updated: 06.10.2026
1. Seller
The online shop available through www.spectrum-imagery.com is operated by:
Phillip Greißel
trading as Spectrum Imagery
Nürnberger Straße 168
91052 Erlangen
Germany
Email: contact@spectrum-imagery.com
2. Scope
These Terms and Conditions of Sale apply to purchases made through the online shop on www.spectrum-imagery.com.
A consumer is any natural person who enters into a transaction primarily for purposes that are outside their trade, business, or profession.
Any conflicting terms submitted by a customer will only apply if expressly accepted by me.
3. Products
The online shop offers photographic prints produced after an order has been placed.
The available image, print size, paper type, finish, and optional border are shown on the relevant product page. Unless expressly stated otherwise, prints are supplied unframed.
The specified print size refers to the dimensions of the printed image. If a white border is selected, the border is added to these dimensions and increases the total paper size.
Images displayed on screens are for illustrative purposes. The appearance of a physical print may differ slightly due to screen calibration, brightness settings, printing processes, paper characteristics, and ambient lighting. Such minor variations do not affect the customer’s statutory rights where the delivered product is defective or materially different from the agreed description.
4. Ordering Process and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer. It is an invitation to submit an order.
The customer can place products in the shopping cart, review the selected products, and correct input errors before submitting the order.
By selecting the button that clearly indicates an obligation to pay, the customer submits a binding offer to purchase the products contained in the order.
The contract is concluded when I accept the order by sending an order confirmation by email. An automatically generated acknowledgement that merely confirms receipt of the order does not constitute acceptance unless it is expressly identified as an order confirmation.
Payment processing alone does not constitute acceptance of the order. If an order is not accepted after payment has already been collected, the payment will be refunded without undue delay.
The contract language is English.
The order details and these Terms and Conditions can be viewed and saved before the order is submitted. The customer will also receive the relevant contractual information by email.
5. Prices and VAT
All prices shown in the online shop are final prices.
In accordance with Section 19 of the German Value Added Tax Act (UStG), VAT is not charged or shown separately.
Shipping charges are not included unless expressly stated otherwise. The applicable shipping costs are displayed before the customer submits the order.
For deliveries outside the European Union, customs duties, import taxes, handling fees, or similar charges may be imposed by the destination country. Unless expressly stated otherwise, these charges are the responsibility of the customer and are not collected by me.
6. Payment
The payment methods available for an order are displayed during checkout.
Payment is due at the time specified during checkout. The customer is responsible for ensuring that the payment information provided is accurate and that sufficient funds are available.
7. Production and Delivery
Prints are produced after the order has been accepted. Production and fulfilment may be carried out by a specialised printing and fulfilment provider acting on my behalf.
The applicable production and delivery estimate is displayed on the relevant product page or during checkout. Delivery estimates are not guaranteed delivery dates unless expressly identified as binding.
Delivery is available only to the countries and addresses offered during checkout.
For consumers, the risk of accidental loss or damage generally passes to the customer when the customer, or a person designated by the customer other than the carrier, takes possession of the goods.
If delivery is materially delayed or becomes impossible, the customer will be informed without undue delay. Statutory rights relating to delayed or failed delivery remain unaffected.
8. Right of Withdrawal
Consumers generally have a statutory right to withdraw from a distance contract within 14 days.
Further information about the conditions, procedure, and consequences of withdrawal is provided in the separate Cancellation Policy. A Model Withdrawal Form is also available.
The fact that a print is produced only after an order has been placed does not by itself exclude the statutory right of withdrawal.
The right of withdrawal may be excluded for goods that are not prefabricated and are manufactured on the basis of an individual choice or decision by the customer, or that are clearly personalised. Any such exclusion will only apply where the relevant product is clearly identified as customised before the order is placed.
The exclusion of the right of withdrawal does not affect statutory rights relating to defective, damaged, or incorrectly supplied goods.
9. Returns Following Withdrawal
The customer must return the goods within 14 days after notifying me of the withdrawal.
The customer bears the direct cost of returning the goods.
Returned goods must be sent to:
Phillip Greißel
Spectrum Imagery
Nürnberger Straße 168
91052 Erlangen
Germany
Customers should package returned prints securely to prevent damage during transport. Use of the original packaging is recommended where suitable, but is not a condition for exercising the statutory right of withdrawal.
Further details are provided in the separate Cancellation Policy.
10. Transport Damage
If goods arrive visibly damaged, the customer should document the damage and contact me as soon as reasonably possible at contact@spectrum-imagery.com.
Where possible, photographs of the packaging, shipping label, and damaged product should be included.
Failure to report transport damage immediately does not affect the customer’s statutory rights.
11. Defective or Incorrect Goods
Statutory rights relating to defective or incorrectly supplied goods apply.
A product may be defective if it is damaged, incorrectly produced, materially different from the agreed product description, or otherwise fails to meet the applicable statutory requirements.
Customers should contact contact@spectrum-imagery.com and provide the order number, a description of the issue, and appropriate photographs where possible.
Where the legal requirements are met, the customer may be entitled to repair, replacement, a price reduction, cancellation of the contract, or damages in accordance with applicable law.
The cost of returning defective or incorrectly supplied goods will not be charged to the customer where I am legally responsible for the defect or error.
12. Retention of Title
The goods remain my property until payment has been received in full.
13. Liability
I am liable without limitation where required by law, including for damage caused intentionally or through gross negligence and for injury to life, body, or health caused intentionally or negligently.
Where I am liable for a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical of the contract. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the customer may ordinarily rely.
Mandatory statutory liability, including liability under applicable product-liability law, remains unaffected.
14. Copyright and Permitted Use
The purchase of a print transfers ownership of the physical print only.
Copyright and all other intellectual-property rights in the photograph remain with Phillip Greißel unless expressly agreed otherwise in writing.
The purchase does not grant the customer any right to reproduce, scan, distribute, publish, modify, commercially exploit, or otherwise use the image beyond displaying the purchased physical print for private purposes.
Resale of the original physical print remains subject to applicable law.
15. Applicable Law
German law applies.
For consumers, this choice of law does not deprive them of mandatory protections granted by the law of the country in which they have their habitual residence.
The statutory rules concerning jurisdiction apply.
16. Consumer Dispute Resolution
I am neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
17. Changes to These Terms
The version of these Terms and Conditions in effect when an order is placed applies to that order.
Any later amendment applies only to future orders and does not retrospectively alter an existing contract.
